Terms of Service
1. Scope and provider
These terms apply to the use of the Discord bot BitGuard, the dashboard at dash.bitguard.app and the website bitguard.app (together “BitGuard”).
The provider is Boostify Digital, sole proprietorship, owner Timon Wodtke, Kücknitzer Hauptstraße 46, 23569 Lübeck. More details are in the imprint.
BitGuard is an independent service and is not affiliated with Discord Inc.
2. Services
BitGuard provides features for Discord servers, for example moderation, protection against raids and nukes, tickets, levels, economy, giveaways and notifications. BitGuard is set up through slash commands and the dashboard.
Using BitGuard is free of charge. We keep developing BitGuard and may change, add or discontinue features. If major features are removed, we will announce this in advance on the website or our Discord server where possible.
3. Requirements
- You need a Discord account. Discord's terms and policies apply to its use.
- You must meet the minimum age Discord requires in your country (13 in most countries).
- Only people with the “Manage Server” permission on a server may add BitGuard to it and configure it in the dashboard.
4. Responsibility of server teams
Whoever uses BitGuard on a server decides which modules are active and how they are configured. Therefore:
- The server team is responsible for its settings, for example automatic punishments, AutoMod rules, role assignments and the permissions it gives the bot. Moderation decisions on a server are made by that server's team, not by us.
- The server team is responsible for the content it publishes through BitGuard, for example embeds, welcome messages, custom commands and scheduled messages. This content must not violate applicable law or Discord's policies.
- If a server uses features such as logging or ticket transcripts, the server team informs its members about it, for example in the server rules. What BitGuard stores is described in the privacy policy.
5. Prohibited use
In particular, you may not:
- use BitGuard for spam, harassment, fraud or other unlawful purposes,
- technically bypass limits, bans or Premium restrictions,
- overload BitGuard, the dashboard or the interfaces behind them, query them automatically or test them for vulnerabilities without our consent,
- resell BitGuard or access to it.

6. Premium
Premium is currently a free trial access that we grant at our own discretion, for example to partners. There is no right to receive or keep Premium. We may change or end the trial access and its scope at any time. When Premium ends, the limits of the free version apply again. Settings are kept, anything above those limits is paused, and a custom bot profile (name, picture) is reset.
Should Premium be offered for a fee in the future, separate terms will apply and will be shown before any purchase.
7. Availability
We try to keep BitGuard running without interruption, but we cannot promise any particular availability. Maintenance, technical faults and outages at Discord or our service providers may limit its use. The current state is shown on the status page.
8. Data
How we process personal data is explained in the privacy policy. A server's owner can export and delete that server's data in the dashboard. If BitGuard is removed from a server, we delete that server's data 30 days later.
9. Termination and suspension
You can start or stop using BitGuard at any time by removing the bot from your server. No notice is required.
If a server or a person violates these terms, we may suspend its use in whole or in part, for example by removing the bot from a server or blocking dashboard access. We take into account the severity of the violation and the legitimate interests of those affected. For less serious violations, we will warn beforehand where possible.
10. Liability
We are liable without limitation for damage resulting from injury to life, body or health, for intent and gross negligence, and under the German Product Liability Act.
Since BitGuard is provided free of charge, we are otherwise not liable for slight negligence. This applies in particular to damage caused by outages, data loss or actions configured by a server team (see section 4). Please keep your own backups of important server content.
11. Changes to these terms
We may change these terms, for example when BitGuard, the law or Discord's terms change. We will announce significant changes at least 14 days in advance on the website or our Discord server. If you do not agree, you can remove BitGuard at any time.
12. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country you live in remain unaffected.
Should any provision be invalid, the remaining provisions remain in effect.
